Legal professionals often face challenges in understanding their clients’ functional restrictions, employability, and the accuracy of vocational information. Conflicting reports and unclear job demands can lead to delays and frustration, potentially impacting the outcome of claims.

Assessments of Employability (TPD)

Our Employability Assessment analyses work capacity within the context of the specific definition written in the contract between the insurer and the policyholder.

It provides evidence of current employability in the open, real-world labour market. Our assessments will also source rates of pay from various sources, including award structures and market sources where required. These assessments can include an interview with the client or be conducted in a “paper-based” or “desktop” style.

Having completed hundreds of TPD assessments over many years for insurers, the Skilled Health team excels at providing critical analysis of previously completed TPD assessments, identifying any missing or misrepresented information.

Vocational Assessment in personal injury

A Vocational assessment involves identifying appropriate or suitable work options for an individual, considering various factors.

Such factors include:

  • Education
  • Training
  • Experience
  • Location and availability of work
  • Physical capacity for work
  • Psychological capacity for work
  • Availability of suitable employment to the person being assessed
  • Ability to successfully complete any proposed retraining
  • Ability to participate in job-seeking activities
  • Ability to both access new employment and maintain new employment with a new employer

The vocational assessment process may include a face-to-face interview, a telephone interview, or a review of relevant documents.

Expertise in forensic vocational assessment is crucial in situations where:

  • There is uncertainty about an individual’s ability to return to their previous occupation due to reduced physical or psychological capacity.
  • Alternative work options need to be identified for individuals unable to return to their pre-injury occupation.
  • Alternative work options have been identified but there is concern, confusion or uncertainty about how these vocational options apply to the person being asked

Work Capacity Disputes

A Work Capacity Dispute may occur when a worker injured in NSW disagrees with the insurer’s decision regarding their work capacity and/or expected earnings for suitable employment.

As skilled forensic vocational assessors, Skilled Health can provide opinions to resolve disputes. For example, we can determine if an assessment used for a work capacity decision was applied correctly or question the source and application of identified transferable skills from an injured worker’s employment history.

Skilled Health also assists with older style s40 assessments.

  • Assessment of skills transferable to alternative employment.
  • Application of documented medical capacity for employment (physical, psychological, or both).
  • Identification of suitable job matches based on transferable skills and functional capacity.
  • Determination of future economic loss due to injury and subsequent changes in earning capacity.

Activities of Daily Living (ADL) assessment

Activities of Daily Living (ADL) refers to daily self-care activities within an individual’s place of residence, in outdoor environments, or both. A person’s ability or inability to perform ADLs is commonly used as a measurement of their functional status, particularly for people with disabilities and the elderly.

At Skilled Health, our medico-legal ADL assessment evaluates the impact of an injury on a client’s ability to manage daily activities at home. We aim to understand their abilities and limitations thoroughly.

Our assessments provide recommendations regarding the need for domestic assistance and home modifications. These recommendations are designed to help clients achieve a more independent lifestyle.
